Contest Organizer
The contest organizer is FRVR Limited, a private limited liability company registered under the laws of Malta with the company number C-82019, VAT number MT24548624, with registered head office at 61, St. Paul Street, Valletta, VLT 1212, Malta (“FRVR”), which organizes this skills game contest with the main purpose of increasing its brand awareness and growing the business through the engagement of the users’ community.
Purpose and Scope of the Contest
2.1. The skills game contest is called the “Idle Game Contest” and aims to award prizes
to the applicants that create and submit the most original and creative game by using
Upit.com with the theme Idle (“Contest”) and that meets the terms and conditions
foreseen in this contest regulation (“Regulation”).
2.2. The total prize pool is $2500 (two thousand and five hundred/00), which will be distributed among the winners.
2.3. The Contest will take place between January 20th and March 6th, 2025, 11:59 p.m., and the applications submitted after this timeframe will not be accepted.
Recipients and participation conditions
3.1. Any natural person may participate in the Contest.
3.2. Minors under the age of 18 (eighteen) years old must present a statement signed by their parents or legal representatives authorizing their participation in the Contest and the processing of their personal data by FRVR and the minor shall sought the parents or legal representatives' assistance with any aspect of the Contest, in accordance with the terms and conditions of this Regulation.
3.3. To ensure fairness and equality of circumstances for applicants, the participation by FRVR and FRVR’s subsidiaries employees, family members, or any other person that might have privileged information regarding the Contest or that helped to set up the Contest, is expressly prohibited.
Terms and Conditions
4.1.To enter the Contest, the applicants shall create and publish an Idle genre game,
tag it with #UpitIdleContest and also submit it at the following link.
4.2. The game shall be made using the game creator on https://upit.com/ and must be
of the Idle genre.
4.3. The applicants may participate and be credited for a single submission in the Contest. It is allowed to provide help to other players’ submissions, but applicants would not be credited for their assistance.
4.4. Once the game is submitted, the applicant is allowed to make any kind of changes until the deadline. Once the deadline has passed, the game will be frozen and the applicant will be unable to edit it.
4.5. The game must be public by the time it is submitted.
4.6. FRVR shall not be liable for the incorrect or inaccurate data provided by the applicants, which may result in disqualification.
4.7. If the same game is used more than once in this Contest, only the first application made with such a game will be considered.
4.8. FRVR reserves the right to disqualify the applicants that submit a game that does not respect this Regulation, that copied artwork from previous contest winners, or that might reasonably be considered illegal, illicit, scandalous, insulting, defamatory, harmful, immoral, vulgar, and/or obscene.
4.9. The applicants may promote their games through any legal means, provided that such promotion does not compromise the fairness of the contest or manipulate engagement metrics. Any attempts to artificially inflate engagement through fraudulent methods, including but not limited to the use of bots or fake accounts, will lead to disqualification.
4.10. The application to the Contest implies the full acceptance of this Regulation.
Prizes and Awarding of Prizes
5.1. The following prizes will be awarded to the Contest winners:
1st place: the amount of $1000 (one thousand/00);
2nd place: the amount of $700(seven hundred/00);
3rd place: the amount of $500 (five hundred/00);
4th place: the amount of $300 (three hundred/00);
5.2. The winners will be contacted by FRVR by e-mail or direct message, within 60 days after the end of the Contest and such communication will include the winners’ complete information and a description of the prize that will be received.
5.3. The winners shall provide FRVR a valid and updated copy ID number - or Business ID, as applicable - and the bank account or PayPal account details, to which the transfer of the prize shall be made.
5.4. The prizes will be paid by transfer to the bank or Paypal account whose details were provided by the winners within a maximum period of 30 (thirty) days after the winners have been announced and FRVR shall provide them with the respective proof of payment.
5.5. If FRVR is unable to contact the winners within a maximum period of 5 (five) days after sending the e-mail outlined in paragraph 5.2, FRVR reserves the right to select any other winners who meet all the conditions set in this Regulation.
5.6. The awarding of prizes is limited to one prize per person during the timeframe of the Contest.
5.7. If the winners are Maltese citizens, they undertake to disclose any amounts received as prizes under the Contest to the competent Maltese Tax Authorities.
5.8. The prize shall not give rise to any kind of claim by the winning participants, nor to replacement or exchange, for any reason whatsoever.
5.9. If the information provided under section 5.3 will not be provided by the winners, the payment of the prize will not be processed by FRVR.
5.10. Any natural person resident in countries subject to, among others, European Union and United States economic sanctions may participate in the Contest but FRVR cannot guarantee - for reasons behind FRVR control - that these participants will receive the payments due under this Regulation. FRVR will use its best endeavors to promptly execute all payments. If not possible FRVR will retry to execute such payment when possible.
Winner Selection Process
6.1. The winner will be determined based on the popularity of the game submission, as measured by the number of unique plays recorded during the period mentioned in section 2.3 above.
To ensure fairness, only plays by real users will be counted.
Any activity involving bots, fake accounts, or other manipulative practices to artificially inflate play counts will be disregarded.
FRVR will analyze and verify play data to ensure the most popular game is selected based on legitimate, human participation. We will actively monitor and review play data to identify and prevent fraudulent activities. If any suspicious activity is detected, FRVR reserves the right to adjust play counts or disqualify submissions at its sole discretion.
6.2. The decisions taken by the jury are final and definitive.
Intellectual Property
7.1. The applicant shall be the author of the game, which cannot contain any content, element, or material that violates a third party's intellectual property rights.
7.2. The applicant assigns to FRVR the full ownership of the game and any inherent intellectual property rights, without the applicant being entitled to any type of compensation or indemnity, except as outlined in this Regulation.
7.3. The applicant is solely responsible for the game created and agrees to indemnify and hold harmless FRVR from and against any third-party claims, losses, damages, liabilities, obligations, penalties, judgments, awards, costs, expenses, and/or disbursements that may arise from the artwork and any violation of third-party rights.
Applicable Law
This Regulation is governed by Maltese Law.
